Terms and Conditions

The Plant Gear Rewards Program (the “Program”), which is operated by Gameball, is designed to help you get the most out of your relationship with PlantGear.com. We reward you for trading and working with us — and growing your relationship with us — plain and simple. The following terms and conditions (these “Rewards Program Terms and Conditions”) contain important information regarding the Program. Please read the following Rewards Program Terms and Conditions carefully.

These Rewards Program Terms and Conditions are incorporated into the Site Terms and Conditions and Privacy Policy. Acceptance of the Site Terms and Conditions includes acceptance of these Rewards Program Terms and Conditions. These Rewards Program Terms and Conditions are a binding agreement between you and Plant Gear and will govern your participation in any and all Program offers. You may not use the Program if you do not agree to these Rewards Program Terms and Conditions.

Participating in the Program entitles members (“Members”) to take advantage of certain Program rewards (“Rewards”) that may change from time to time and, which may be made available for limited times, all as determined by Plant Gear in its sole discretion. Plant Gear reserves the right to modify these Rewards Program Terms and Conditions at any time, without notice to you, so it is important to check the Rewards Program Terms and Conditions periodically. The date of the last update will appear at the top of these Rewards Program Terms and Conditions. Participation in the Program or redemption of Rewards is considered acceptance of these Rewards Program Terms and Conditions and any modified terms included therein.

Program Period

This Program will continue until terminated, suspended, modified, or converted to another rewards program by Plant Gear, which Plant Gear may do at any time and in its sole discretion, with or without notice (the “Program Period”).

Eligibility

Enrollment is free for everyone. To enroll in the Program as a Member, you must register on Plant Gear. After registration, simply click the “Rewards” icon in the right side of the website. You will be guided through all steps. Enjoy!

Earning Points

Once you have become a Member, you can begin earning Program points (“Points”) in the following ways, which may be expanded or reduced periodically as communicated via email to Members:

• 5 points for every 1 dollar spent
• Create a free account and earn 100 points
• Celebrate a birthday and earn 200 points
• Make a purchase and earn 50 points
• The third and fitth order placed will each earn an extra 100 points
• Order value total 100 dollars will earn extra 100 points
• Follow us on Instagram and earn 250 points
• Share us on Instagram and earn an additional 250 points
• Share us on Facebook and earn 250 points
• Write a review and earn 50 points
• Upload a photo review and earn 200 points
• Buy any products from 3 different collections and earn 150 points
• Buy any 3 items from the Local Specific collection and earn 150 points
• Celebrate account anniversary and earn 200 points
• Place your tenth order with us and earn 500 points
• Refer a friend and friends gets 10% Discount
• Player gets a 10% Discount, with additional 35% Discount For every 5 friends referred

Plant Gear Points Redemption

You can redeem your Points by logging into your Plant Gear account and then you can simply apply as a credit on a current purchase or view your other options.

Refunds & Returns & Timing

Note that Points will only be accrued after the payment of all outstanding invoices that earn Points. Moreover, in the event of any refund, return, or adjustment to a paid invoice, Points will be voided, and if for any reason they have already been used/applied/redeemed, the Member will be invoiced for the amount of cash benefit it received.

PlantGear.com Points Minimums And Maximum

Points are not redeemable for cash, and can only be redeemed for a maximum of 50% of any invoice it is to be applied to. Minimum redemptions: Points must be redeemed for at least $1.00 or more in order to be utilized.

Plant Gear Points Balance

You can always check your PlantGear.com Point balance by logging into your Account.

• 1pt = $0.01
• 100pts = $1
• 250pts = $2.50
• 500pts = $5
• 1000pts= $10

Plant Gear Points Expiration

Points will expire 24 months from the date they were first earned. If Member does not redeem Points within this time frame, Member forfeits all such Points.

Reward Conditions

Rewards may be taxable, depending on the value of the item and the federal, state, and local tax laws applicable to Member and the invoices to which they are applied.

Termination

Plant Gear may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the Program, Points and/or any Reward at any time, including but not limited to the availability of the Program, Points, Rewards, redemption ratios, earning structures, and these Rewards Program Terms and Conditions. Plant Gear may, in its sole and absolute discretion, terminate or suspend any Member’s participation in the Program for breach of these Rewards Program Terms and Conditions, or for taking any actions that are inconsistent with the intent of these Rewards Program Terms and Conditions. Plant Gear reserves the right at its sole discretion to prohibit any Member from participating in any aspect of the Program if Plant Gear deems or suspects that such Member has engaged in or has attempted to engage in any of the following:(a) acting in violation of these Rewards Program Terms and Conditions; or (b) damaging, tampering with or corrupting the operation of the Program or Site; or (c) acting with intent to annoy, harass or abuse any other person; or (d) any inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or (e) activity deemed in the sole discretion of Plant Gear to be generally inconsistent with the intended operation of the Program. Any decision Plant Gear makes relating to termination or suspension of any Member’s participation in the Program shall be final and binding in all respects. Plant Gear shall be the sole determiner in cases of suspected abuse, fraud, or breach of these
Rewards Program Terms and Conditions or intent of these Rewards Program Terms and Conditions.

Release

Except for willful misconduct or gross negligence on the part of Plant Gear, by participating in the Program, Members release Plant Gear, its parent companies, subsidiaries, affiliates, suppliers, advertising and promotions agencies and their respective directors, officers, employees, and agents (collectively,“Released Parties”) from any and all liability for any loss, harm, damages, cost or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the Program or the use of any Rewards. Without limiting the foregoing, under no circumstance will Plant Gear be liable for any consequential, punitive, or other special damages.

Indemnification

Members agree to indemnify, defend and hold Plant Gear and its representatives and agents harmless from and against any and all third party claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to any breach by Member of any of these Rewards Program Terms and Conditions or any violation by Member of applicable law.

Additional Terms

The Program is void where prohibited. Plant Gear shall, in its sole discretion, determine the number of Points earned for any expenditure. Points may not be transferred or assigned to any other person.
